Terms of Service

Last updated: 2026-10-24

Welcome to Xinote. Xinote is operated by Jiayi Li (Melbourne, Victoria, Australia). By using Xinote, including guest mode, you agree to these Terms and our Privacy Policy. If you don’t agree, please don’t use Xinote.

1. Who can use Xinote

You must be at least 13. If you are 13 to 17, you need permission from a parent or guardian, who also agrees to these Terms. Provide a real email address and keep your account secure; you are responsible for activity on your account.

2. Get permission before you record

Recording is at the heart of Xinote, so please take care:

  • Before recording a class, check that your school and teacher allow it. Many institutions have rules about recording lectures.
  • In Australia, recording a private conversation without consent can be illegal (for example under the Surveillance Devices Act 1999 (Vic)). Only record where it is lawful and permitted.
  • Don’t use Xinote to secretly record people, and don’t publish or share recordings or other people’s voices.
  • Recordings, transcripts and notes are for your personal study.

3. Your content

  • Audio you record, materials you upload and notes generated for you belong to you (or the original rights holder).
  • You give us permission to store and process this content and to send it to our transcription and AI providers (see the Privacy Policy), solely to provide Xinote to you.
  • Only upload slides, handouts and other materials you have the right to use (for example course materials your school gave you, for personal study).
  • You can delete your content at any time.

4. AI output is a study aid

Transcripts, notes and answers are generated automatically and may mishear, miss or misstate things, especially with poor audio, several speakers or specialised terms. Check important details (such as exam dates, assignment requirements and formulas) against the original recording, and don’t rely on AI output alone.

Follow your institution’s academic integrity rules. Xinote helps you review and understand your classes; it is not a substitute for doing your own assessments.

5. What you must not do

If you break these rules we may remove content, or suspend or close your account.

  • Record unlawfully, or record or upload content that infringes others’ privacy, copyright or other rights.
  • Upload illegal, harassing, violent, sexual or hateful content.
  • Try to break into, disrupt or get around Xinote’s security or usage limits, or use it through automated bulk access.
  • Impersonate others, or transfer or sell your account.

6. Changes to the service

Xinote is currently free, with usage limits for guests and accounts. We may change features or limits, or introduce paid plans later; we will explain any pricing changes in advance and never charge you without your knowledge. We work to keep Xinote reliable but cannot guarantee it will be uninterrupted or error-free. If we decide to shut Xinote down, we will give you notice so you can keep what you need.

7. Liability

Nothing in these Terms excludes or limits rights you have under the Australian Consumer Law that cannot be excluded.

To the extent permitted by law, Xinote is provided “as is”, and we are not liable for indirect loss caused by inaccurate AI output, service interruptions or lost data. Keep your own copies of anything important.

8. Ending your use

You can stop using Xinote at any time and delete your account on the Account page, or email support@xinote.app and we will do it for you. We may close your account if you seriously or repeatedly breach these Terms.

9. Governing law

These Terms are governed by the laws of Victoria, Australia, and the courts of Victoria have jurisdiction over any dispute.

10. Changes to these Terms

If we make significant changes we will let you know on the website. Continuing to use Xinote after changes take effect means you accept the updated Terms.
